I. SUBJECT MATTER OF THE TERMS AND CONDITIONS
Art. 1. These General Terms and Conditions govern the terms and conditions for the provision of publishing products by the University Press of Thrace, offered through the publisher’s website https://press.trakia-uni.bg/, subject to the user’s strict compliance with the requirements set out therein.
Art. 2. In the event of changes to the General Terms and Conditions, the Publishing House shall be obliged to notify the User by publishing a notice of the changes to the General Terms and Conditions and the actual text of the amendments in a prominent place on the website https://press.trakia-uni.bg/.
Art. 3. By accepting these General Terms and Conditions, the User agrees to comply with them in the version published on the website of the University Press of Thrace at the time of acceptance.
II. USE OF THE WEBSITE
Art. 4. The entire content of the website https://press.trakia-uni.bg/ including text, drawings, graphics, photographs, databases, designs, videos, trademarks, software programs, logos, slogans and other information, constitute copyright within the meaning of the Copyright and Related Rights Act, respectively the Trademarks and Geographical Indications Act, and are the property of University Press of Thrace and/or its partners, customers or users who have provided the relevant protected objects or publishing materials for use.
Art. 5. No part or all of the Content may be copied, transmitted, distributed, stored or otherwise used in any form without the express written permission of University Press of Thrace;
Art. 6. User may not use the Website to send or transmit any material that is unlawful, threatening, false, misleading, abusive, harassing, defamatory, libelous, vulgar, obscene, scandalous, inflammatory, pornographic or religiously incorrect content, or any material that establishes or encourages conduct that would be considered a crime, give rise to civil or criminal liability, or otherwise violate the law.
III. REGISTRATION
Art. 7. Access to the publishing products offered by the University Press of Thrace is through registration on the website https://press.trakia-uni.bg/.
Art. 8. When registering, users fill in a request form in which they enter the following information: first and last name, e-mail address and password. The password shall meet the minimum security requirements.
Art. 9. Access to the Publishing House’s website shall be via the username and password entered in the registration form.
Art. 10. The Customer is fully responsible for entering complete, true, accurate and up-to-date information required in connection with his registration and creation of a Customer profile.
Art. 11. Users shall receive an e-mail confirming their registration.
Art. 12. In case of loss (forgetting) of the password or username and an explicit request from the user, the University Press of Thrace is obliged to send new ones to the e-mail address personally indicated by the user.
Art. 13. Trakia Press University Press assumes no liability for the timeliness, deletion, failure to deliver or retention of the user’s personal settings, or for damages and loss of profits resulting from, resulting from or due to the exhaustion of books, including the inability to use the site due to technical problems, maintenance, etc.
Art. 14. University Press of Thrace, shall not be liable for any damages or losses arising from failure to comply with the provisions of this section.
IV. PRIVACY POLICY
Art. 15. Trakai University is a personal data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data in force since 25.05.2018 and national legislation. Trakai University collects personal data and uses the collected personal information solely and exclusively in connection with the purposes of the services offered.
Art. 16. The information may include: first and last name, email address, postal address, telephone number, data collected at the time of payment – credit or debit card number, bank account and other payment information collected when processing the payments requested by the customer, as well as any other information that the customer voluntarily provides when purchasing the publishing output of the University Press of Thrace.
Art. 17. The user agrees that, when concluding a distance sales contract, part of his/her personal data will be provided to the respective subcontractor company for the purpose of carrying out the delivery of the on-line order created. Such personal data are: name, address, telephone number.
Art. 18. The personal data collected shall be stored and processed in compliance with the requirements of the Personal Data Protection Act and the General Data Protection Regulation (EU) 2016/679, observing all applicable data protection rules. In all specific written statements and agreements, as well as in the acceptance, interpretation and application of these General Terms and Conditions, the language applicable between the parties shall be the Bulgarian language.
V. COOKIE POLICY. SECURITY AND IDENTIFICATION
Art. 19. “Cookies are small files containing data that a website transfers from the internet browser to the computer or other device (mobile phone) with which the customer uses the internet, temporarily for the duration of the visit to the website or for a longer period, depending on the type of cookie used.
Art. 20. The University of Thrace uses temporary cookies to make it easier for customers to access the website of the University Press of Thrace. The purpose in using cookies” is to recognize the user within the specific session, to control the security of the connection and to ensure that the information entered by the user is only visible by the user.
Art. 21. “Identification and security cookies are automatically deleted after the termination of the session of the Internet browser used or are kept for a limited time in order to ensure a smooth operation of the site. These cookies and other types of cookies on the website do not store personal data entered by the customer.
Art. 22. In the event that the customer does not wish to accept the use of cookies, he can deactivate them from the settings of the Internet browser he uses. In the event that the customer opts out of cookies, some functions may not work properly.
VI. PRICES
Art. 23. All prices of the Products or Services are final, are stated in BGN (EUR), inclusive of VAT and any other required taxes or fees.
Art. 24. Trakia Press University Press shall have the right to change prices at its sole discretion, at any time, without prior notice to users.
Art. 25. The user is obliged to pay the price that was indicated on the website at the time of making(creating) the order, regardless of whether it is lower or higher than the current price.
Art. 26. In the event of technical errors in the data entered for the user, the University Press of Thrace shall have the right to refuse the execution of the order and shall not owe compensation in any way to the user, except to refund the amounts paid and/or deposited by him, if any.
Art. 27. All products, including those on promotion or discount, are sold and delivered until stocks are exhausted, even if this is not expressly stated on the website.
VII. PAYMENT
Art. 28. In the case of payment in cash/cash on delivery of ordered publishing products, the user undertakes to hand over to the person making the delivery, at the time of delivery, the full value of the order delivered.
Art. 29. In the case of payment by bank transfer in BGN, the user shall deposit an amount equal to the value of the order placed in the bank account of Thracian University and only after the deposit has been confirmed shall the ordered books/publishing production be delivered. The order number must be entered in the reason for payment. All fees and commissions are the responsibility of the user.
Art. 30. In case of electronic payment by debit/credit card in BGN, the user shall pay an amount equal to the value of the order to the account of Thracian University and only after the amount is confirmed, the ordered books/publishing production shall be delivered. The order number must be entered in the reason for payment. All fees and commissions are the responsibility of the user.
Art. 31. If a user has opted for electronic payment by debit/credit card , the e-books are added to his/her account only after the transaction has been confirmed.
VII. DELIVERY
Art. 32. Delivery within the country is carried out by courier – Speedy company and is realized within the established terms.
Art. 33. The price of deliveries to the territory of the Republic of Bulgaria is automatically calculated according to the total weight of the order and according to the established prices of the listed couriers and are available at their e-mail addresses. The transport costs shall be borne by the users.
Art. 34. University Press of Thrace reserves the right to extend the stated deadlines by up to 7 days without informing the user in advance and to extend deadlines beyond 7 days with the prior approval of the user.
Art. 35. University Press of Thrace reserves the right to change the person making the delivery without prior notice to the user, without thereby changing the price, the time limit, or the method of delivery.
Art. 36. In the event that the consumer is not found within the delivery period at the address indicated by him or the access and conditions for delivery of the goods are not provided within this period, University Press of Thrace shall be released from its obligation to deliver the publishing production requested for purchase. In this case, the user has the right to confirm the order, bearing all delivery costs. In this case, a correspondingly new delivery period starts from the moment of confirmation under the previous sentence.
VIII. ELECTRONIC PUBLICATIONS
Art. 37. When purchasing electronic editions, the user is obliged to read the information in the section How to download e-books!
Trakia Press University Press is not responsible for the inability to use the product in case of non-compliance with the mentioned instructions!
IX. PAYMENT TERM
Art. 38. The payment term for orders requiring prepayment is up to 7 days from the date of order generation on the website. After the expiry of this period and in the event of non-payment, the order shall be deemed to have been refused.
IX. ORDER CANCELLATION. CANCELLATION OF GOODS. RETURN OF GOODS
Art. 39. Within 24 hours of placing the order and in the event that the publishing production has not left the premises of the University Press of Thrace, the consumer has the right to cancel the order. Cancellation should be made at https://press.trakia-uni.bg/. When making the cancellation, users shall indicate: name, order number and date, description of the publishing production.
Art. 40. A consumer who falls under the protection of the Consumer Protection Act shall have the right to cancel one or more of the books ordered without giving any reason, without compensation or penalty and without paying any costs within 14 days from the date of acceptance of the goods, in accordance with the terms of Article 50 of the Consumer Protection Act.
Art. 41. In exercising his right of withdrawal under subsection 2 of this section, a consumer falling under the protection of the Consumer Protection Act shall only be liable for the costs referred to in Articles 54 and 55 of the Consumer Protection Act.
Art. 42. In order to exercise the right of withdrawal, the buyer may use the standard withdrawal form (download here) or send the following data to bookshop@trakia-uni.bg: 1. Order number, 2. Customer name 3. Contact phone number 4. IBAN 5. Account holder. 6. Name of product to be returned.
Art. 43. The refund will be made within 14 days from the date of termination of the distance selling contract by the buyer.
Art. 44. 13 of the LPA – digital content which is not delivered on a tangible medium; pursuant to Article 57, paragraph 9 of the LPA – sealed sound recordings or video recordings which are printed after delivery.
Art. 45. A consumer shall have the right to refuse to receive the publishing output he has requested for purchase where: the publishing output delivered is clearly not in conformity with the one requested for purchase by the consumer and this can be ascertained by ordinary examination; and/or the publishing output or its packaging has been damaged during transportation; and/or the price to be paid by the consumer does not correspond to the price due.
Art. 46. In the event of non-conformity of the goods with the main characteristics indicated on the page, the University Publishing House Thrace Press shall refund the amount paid for the goods by the consumer, including the transport costs charged for the acquisition of the goods, in accordance with Article 59(3) of the Consumer Protection Act within 14 days of receipt of the goods.
Art. 47. The provisions of Articles 50-56 of the Consumer Protection Act shall not apply to contracts which provide digital content (eBooks) which is not delivered on a tangible medium but is downloaded from the website, where performance has been initiated with the express consent of a consumer who has confirmed that he knows that he will thereby lose his right of withdrawal.
